Terms and Conditions of Sale

Terms for Beathoven services, in-app or by quote, for artists, managers and labels.

Seller and scope

Pablo GROOT — sole trader under the micro-enterprise regime. Trading name: Beathoven. SIREN: 893 132 274. SIRET: 893 132 274 00042. Address: Beathoven, 200 rue de la Croix Nivert, 75015 Paris, France. SIRET: 893 132 274 00042. Contact: contact@beathoven.tv.

These terms apply to services ordered from Beathoven. Any specific terms accepted set out the scope of the order and do not deprive the consumer of mandatory rights. The rules of third-party platforms apply to their own services.

Services and pricing

Free EPK: preparation and publication after the required elements are completed, without automatic outreach.

Studio: €29 per month, automatic renewal, ongoing EPK support and preparation, up to 15 submissions per paid monthly period.

Autopilot PR: €59 one-time payment, 15-day campaign, up to 30 submissions, log and report.

Meta and YouTube: Beathoven fee of €39 per campaign, or €19 with an active Studio at time of purchase. The media budget is separate, paid directly to Meta or Google and subject to their billing rules.

Visibility & Discovery and human EPK creation: scope, pricing, timelines and deliverables set out in the accepted quote. These services are distinct from the standalone EPK.

Amounts are in euros. Tax regime: VAT exemption scheme — VAT not applicable, article 293 B of the French General Tax Code (CGI). As declared under our tax regime. The pre-order summary shows the total amount and any applicable taxes. Third-party fees not included must be identified before commitment.

Ordering and payment

Placing an order implies reviewing the offer, price, scope and these terms, then accepting them and confirming the payment obligation. The payment flow uses Stripe. Order confirmations and reference numbers must be retained.

A new version of the Terms and Conditions does not retroactively alter an already concluded order. If payment is recorded but there is no visible activation, contact the team before making any further payment.

Studio subscription

The subscription renews monthly according to the period shown in Account and the subscription confirmation. You can request or effect cancellation via subscription management or contact the team if you encounter any difficulty. The effective date is stated in the confirmation; it must not result in billing beyond the applicable period.

One-off purchases remain separate from the subscription. Terms relating to credits or their carryover cannot be assumed unless explicitly stated in the accepted offer.

Fulfilment and validation

Fulfilment requires the information, resources, connections and approvals specified in the process. Applicable dates and deadlines are presented before order or agreed in the quotation. 15-day campaigns begin on activation once the necessary prerequisites and approvals have been met.

You review targets and messages before any email outreach, and parameters and budgets before any advertising activity. A candidate identified, a message prepared, a payment made or a scheduled status do not by themselves prove that an email was sent or that content was published. The statuses and available proofs distinguish these stages.

Announced volumes are maxima; they do not justify approaching an incompatible outlet. Account, platform and access constraints must be reported when they prevent execution. A service that has not been carried out cannot be presented as delivered.

Your content and authorisations

You provide accurate information and the necessary rights for the works, photos, videos, trademarks and contact details supplied. You retain your rights. You authorise Beathoven to process, display and transmit these elements only for the requested services and publications, within their scope.

Beathoven’s original tools, methods and templates remain protected. The usage rights for bespoke deliverables are specified in the quote, without depriving the client of the uses agreed for their project.

Results and liability

Beathoven provides the agreed actions and deliverables with due care. Decisions by media, radio stations, curators and platforms are the responsibility of those third parties. No article, placement, broadcast, audience, streaming figures or return on investment is guaranteed without a specific valid commitment.

The absence of any guarantee of results does not exempt Beathoven from providing the contracted service. Mandatory consumer rights, including legal guarantees applicable to digital services and remedies in the event of non-performance, remain preserved. No clause limits liability that cannot legally be excluded.

Consumer right of withdrawal

Under a distance service contract, consumers generally have 14 days from the date of conclusion to withdraw, except where legally applicable exceptions apply. They may notify their decision by a clear statement to contact@beathoven.tv or by post to the publisher's address.

If the consumer expressly requests that the service begin before the end of the withdrawal period, they retain their right to withdraw until the legal conditions for its forfeiture are met. If they withdraw after such a requested and properly informed start, only the proportionate amount for the service actually provided may be due in accordance with the law. Forfeiture of the right to withdraw for a service that has been fully performed requires the necessary consents and information; mere payment or access to the application does not constitute waiver.

For digital content supplied without a physical medium, any exceptions require the specific conditions set out by law. They do not apply indiscriminately to all offers. Refunds will be made in accordance with statutory time limits and procedures.

Model withdrawal notice

To Beathoven, 200 rue de la Croix Nivert, 75015 Paris, France, contact@beathoven.tv: 'I hereby notify you of my withdrawal from the contract for the following service: … Ordered on: … Name: … Address: … Date: … Signature only if sent on paper.'

Complaints and mediation

Send a written complaint to contact@beathoven.tv stating the service and the order reference. After an initial attempt to resolve the matter with Beathoven, the consumer may, subject to admissibility, refer the case free of charge to the designated mediator: the consumer mediator designated as of today.

Mediation does not preclude other avenues of recourse. French law applies, subject to mandatory consumer-protection provisions; the competent courts are determined by law.
